The President of the Republic of Srpska Milorad Dodik filed criminal charges against Christian Schmidt from the Federal Republic of Germany to the District Public Prosecutor’s Office in Banja Luka.
In a longer period of time, starting from August 1, 2021, Christian Schmidt is dealing with the affairs of the high representative without authorisation, for which he does not have a decision on the appointment made by the competent authority, which is necessary for the appointment of the high representative, and who continuously, with the intention of causing some damage to the Republic of Srpska, falsely presents himself as an official, i.e. as high representative in Bosnia and Herzegovina, knowing that he was not appointed in accordance with Annex 10 of the Agreement on Civilian Implementation of the General Framework Agreement for Peace in Bosnia and Herzegovina, as a result of which he cannot have the legitimacy and authority to make a legally valid decision in the name and on behalf of the high representative in Bosnia and Herzegovina.
Christian Schmidt is engaged in an unauthorised occupation for which, according to the law or other regulations adopted on the basis of the law, permission is required from the competent authority, i.e. organisation, and with the intention of causing some damage to another, he falsely represents himself as an official, thereby committing a criminal offense and false representation from the Criminal Code of the Republic of Srpska.
Also, the President of the Republic of Srpska Milorad Dodik sent a criminal complaint against Dragan Prusina, Director of JP NIO Official Gazette of BiH, to the Prosecutor’s Office of Bosnia and Herzegovina, because by performing the function of director, as an official and responsible person in the institution of BiH – JP NIO Official Gazette of BiH, he used his position and authority, exceeding the limits of his official authority, i.e. knowingly violating the law and obviously acting negligently in the performance of his duties, in such a way that, acting contrary to the provisions of Article 5 of the Law on the Official Gazette of BiH, and as far as he was aware, by his influence, actions and decisions enabled the publication of the decisions of the so-called high representative in the Official Gazette of Bosnia and Herzegovina, which seriously violated the rights of the Republic of Srpska, that is, as a result of which there was a serious violation of the rights of the Republic of Srpska.
Dragan Prusina, as an official or responsible person in the institutions of Bosnia and Herzegovina, by taking advantage of his position or authority and by exceeding the limits of his official authority, seriously violated the rights of another, i.e. by knowingly violating the law, other regulations or a general act, clearly acting negligently in the performance of his duties, as a result of which a serious violation of the rights of another occurred, thereby committing the criminal offense of abuse of position or authority from the Criminal Code of Bosnia and Herzegovina, i.e. the criminal offense of negligent work in the service.
