The
President of the Republic of Srpska shall have the following constitutional
and legal powers and competencies to:
•
Represent the Republic of Srpska,
• Propose to the National Assembly the candidate for the President
of the Government,
• Propose the candidate for the President of the Government within
ten days from the day of accepting the resignation, voting non-confidence
or cessation of the mandate of the previous Government because
of dismissal or reducing the mandate of the National Assembly,
• Request from the President of the Government to resign, after
initiative of at least twenty members of the National Assembly
and after he listens to opinion of the Speaker of the National
Assembly and President of the Government, if he estimates that
crisis in performance of the Government has appeared. If the Prime
Minister refuses to place the resignation, the President of the
Republic may dismiss him,
• Request from the Government to report on some issues that are
significant for the Republic of Srpska, convene the Government
Session and put the issue from within its competence on the agenda,
• Propose to the National Assembly candidates for the president
and judges of the Constitutional Court of the Republic of Srpska
at proposal of the High Judicial and Prosecutorial Council,
• Promulgate the Law by Decree within seven days from the day
of its adoption by the National Assembly. Within that timeline,
the President of the Republic may request from the National Assembly
to make decision on the Law anew. The President of the Republic
is obliged to promulgate the Law which has been readopted by the
National Assembly,
• Pass decrees with the force of law regarding the issues falling
under the competence of the National Assembly, and appoint and
recall the officials appointed by him that is, appointed and recalled
by the National Assembly. If not possible to convene a session
of the National Assembly during state of war and state of emergency
announced by the BiH institutions, at the proposal of the Government,
or at his own initiative or after he has heard the opinion of
the Speaker of the National Assembly,
• Perform, in accordance with this Constitution and the Constitution
of Bosnia and Herzegovina and law, tasks related to defense, security
and relations of the Republic of Srpska with other countries and
international organisations.
• Allow restricted use of the Republic of Srpska Army units in
order to provide support to civil authorities in their work during
natural disasters and misfortunes, in line with the Law on Defense
of Bosnia and Herzegovina,
• Appoint and recall by decree heads of missions of the Republic
of Srpska in foreign countries, and nominate ambassadors and other
international representatives of Bosnia and Herzegovina from the
Republic of Srpska, at proposal of the Government,
• Form advisory bodies and expert agencies for performing tasks
falling within his competency,
• Grant pardons,
• Confer decorations and awards specified by law,
• Decide to dismiss the National Assembly after hearing the opinion
of the President of the Government and the President of the National
Assembly,
• Request from the President of the National Assembly of the Republic
of Srpska to call for a session of the National Assembly of the
Republic of Srpska,
• Propose laws, other regulations and general acts,
• Start the procedure for evaluating the constitutionality and
legality before the Constitutional Court, without restrictions,
• Submit a proposal to initiate amendments of the Constitution
of the Republic,
• Convene and chair the sessions of the Senate as an advisory
body of the highest institutions of the Republic of Srpska,
• Decide which of the Vice-Presidents of the Republic would replace
him in case he is temporary prevented from performing his duties,
• Perform other tasks in accordance with the Constitution,
• Have two Vice-Presidents from different constitutive peoples,
• The President and Vice-Presidents of the Republic shall be elected
for a four-year mandate by the citizens through direct and secret
ballot,
• The same person may be elected President or Vice-President no
more than twice in a row,
• The President of the Republic and Vice-President of the Republic
shall be elected directly from the list of candidates for the
President of the Republic of Srpska, in a way that the President
shall be the elected candidate with the majority of votes, the
Vice-Presidents shall be the elected candidates from the other
two constitutive peoples who, after the President of the Republic,
have received the majority of votes.
